Welcome to Reliable Power Tools, a division of Reliable Bolt Industrial Supplies (Pty) Ltd. The terms "we", "us" and "our" refer to Reliable Power Tools. We operate reliablepowertools.co.za (the "Site"), including all related content, features, tools, products and services, to give you a curated shopping experience (the "Services"). Reliable Power Tools is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms of Service carefully, as they include important information about your legal rights, including warranty and liability terms. By visiting, using or placing an order through the Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to them, please don't use the Services.

1. Who we are

Reliable Power Tools is a division of Reliable Bolt Industrial Supplies (Pty) Ltd, registration number 1980/002767/07, of 71 Terrace Road, Edenvale, Gauteng, South Africa. You can reach us at sales@reliablebolt.co.za or 011 609 7946. These details, together with what's below, are provided to meet the disclosure requirements of section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

2. Access and your account

You must be at least 18 years old, or have a parent or guardian's consent, to place an order with us. If you let a minor dependant use the Services on a device you own or manage, you take responsibility for that use.

To use the Services, we may ask for information such as your email address, billing details, payment details and shipping address. You confirm that whatever you give us is correct, current and complete, and that you have the right to provide it. If you create an account, you're responsible for keeping your login details secure and for activity on your account, and you may not transfer, sell or license your account to anyone else.

3. Our products

We make every effort to represent our products accurately, but colours and appearance can differ from how they show on your screen depending on your device. Product descriptions may change at any time, and we may discontinue a product or limit quantities available to any person or region at our discretion.

4. Products, pricing and availability

Prices are shown in South African Rand and may change at any time before we accept your order; the price you pay is the price shown when your order is accepted. Prices don't include taxes, shipping, handling or import charges unless stated. We take reasonable care to display accurate stock and pricing information, but errors can happen. If we discover a pricing or stock error after you've ordered, we'll contact you before proceeding.

5. Orders and payment

Placing an order is an offer to buy, which we're free to accept or decline (for example, if an item is out of stock or we suspect fraud). A contract is formed only once we've confirmed and accepted your order, and we may be unable to accommodate a cancellation request after that point. If we don't accept, change or cancel an order, we'll try to notify you using the contact details you provided. Payment methods available at checkout are shown at the time you order, and you confirm that any payment details you give us are accurate and that you're authorised to use them.

6. Returns and shipping

Our Return and Refund Policy and Shipping Policy form part of these terms and explain how returns, refunds and delivery work, including your rights under the Consumer Protection Act 68 of 2008 (CPA) and ECTA.

7. Consumer Protection Act

Where the CPA applies to your purchase, nothing in these terms limits or excludes any right you have under it, including your rights around the quality and safety of goods (sections 55 and 56), fair and reasonable contract terms (sections 48 to 52), and plain language disclosure (section 22). If any part of these terms conflicts with a right the CPA gives you, the CPA takes precedence.

8. Shipping and delivery

Delivery times given anywhere on the Site or in our Shipping Policy are estimates, not guarantees. We aren't liable for delays caused by our courier partners, customs processing, or events outside our control. Once we hand a product to our courier, responsibility for loss or damage in transit is covered under our Shipping and Return and Refund Policies rather than this clause.

9. Intellectual property

All content on the Site, including text, product descriptions, graphics, logos, images and the design and arrangement of the Services, belongs to us or our licensors and is protected by South African copyright, trademark, design and patent law. You may use the Services for your own personal use only, and may not reproduce, distribute, modify, publicly display or commercially exploit any of it without our prior written permission. Our names, logos, product and service names, designs and slogans are our trademarks or those of our licensors and may not be used without our written permission. Shopify's name, logo and trademarks belong to Shopify. All other names, logos and trademarks on the Services belong to their respective owners.

10. Optional tools

We may give you access to tools provided by third parties as part of the Services, which we don't monitor or control. We provide access to such tools "as is" and "as available", without any warranty, and we have no liability arising from your use of them. Using them is entirely at your own risk, and you should review the relevant third party's own terms before relying on them.

11. Third party websites and links

The Services may link to websites or platforms run by third parties. If you follow those links, review their own terms and privacy practices. We don't guarantee and aren't responsible for the content, accuracy or practices of sites we don't control, and a link from us doesn't imply we endorse it.

12. Relationship with Shopify

Reliable Power Tools is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase made through the Site is made directly with Reliable Power Tools, not with Shopify. Shopify isn't responsible for any aspect of the sales between you and us, including any injury, damage or loss resulting from products or services purchased. You release Shopify and its affiliates from any claim, damage or liability arising from your purchases and transactions with us.

13. Your personal information

We collect and use personal information to process your orders, deliver your goods, and run the Site, in line with the Protection of Personal Information Act 4 of 2013 (POPIA). See our Privacy Policy for the full details, including what we collect, how we use it, and how to exercise your rights (access, correction, deletion, and objection to direct marketing). Contact us using the details in section 20 to reach our Information Officer.

14. Feedback

If you send us ideas, suggestions, feedback or reviews, you grant us a worldwide, royalty-free licence to use, reproduce, publish and display that feedback for any purpose, including commercial use, and you confirm it's your own to give and won't infringe anyone else's rights. We're under no obligation to keep feedback confidential, pay for it, act on it, or respond to it, and may remove it at our discretion if we consider it unlawful, offensive or otherwise objectionable.

15. Errors, inaccuracies and omissions

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We may correct these, update information, or cancel an affected order at any time without prior notice, including after you've placed it.

16. Prohibited uses

You may use the Services only for lawful purposes. You agree not to use the Services to break any law, infringe anyone's intellectual property, harass or defame any person, transmit false or misleading information, send spam, impersonate anyone, upload malicious code, scrape or extract data using automated tools, or bypass any security or access control we put in place. We may suspend or terminate your account at any time, without notice, if we determine you've broken any part of these terms.

17. Agents

This section applies if you use, allow, enable or cause an Agent to access, use or interact with the Services. An "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct human supervision. An Agent may only access, use or interact with the Services if it identifies itself in every request (including "Agent/[agent name]" in the request's user agent string), does not conceal or mimic human behaviour, does not attempt to complete or bypass any CAPTCHA or similar measure, answers truthfully if asked whether it is a human or a computer, and does not circumvent any measure we use to control Agent access. We may limit, by technical or other means, whether and how any Agent accesses the Services, and may block an Agent we've asked to stop.

18. Termination

We may end this agreement, or your access to the Services, at our discretion and without notice, and you'll remain liable for anything due up to the date of termination. Provisions that by their nature should continue after termination, including intellectual property, feedback, disclaimers, limitation of liability, indemnification and governing law, will continue to apply.

19. Disclaimer of warranties and limitation of liability

Information on the Site is provided for general purposes, and we don't warrant its accuracy or completeness. Except where the CPA or other South African law gives you a right that can't lawfully be excluded, including your rights around the quality and safety of goods under sections 55, 56 and 61 of the CPA, the Services and any products offered through them are provided "as is" and "as available", without warranties of any kind, and we won't be liable for indirect, incidental, special or consequential loss, including lost profits, revenue or data, arising from your use of the Services or our products.

20. Indemnification

You agree to indemnify and hold us, Shopify and our respective affiliates, officers, directors, employees and agents harmless from any claim, loss, liability or cost, including reasonable legal fees, arising from your breach of these terms, your violation of any law or third party right, or your use of the Services.

21. Severability, waiver and entire agreement

If any part of these terms is found unlawful or unenforceable, the rest will remain in force, and the unenforceable part will be treated as removed. Our failure to enforce any right or provision doesn't waive it. These terms, together with our Return and Refund Policy, Shipping Policy and Privacy Policy, form the entire agreement between you and us regarding the Services, replacing any earlier agreement on the same subject.

22. Assignment

You may not transfer or assign your rights or obligations under these terms without our written consent. We may transfer or assign these terms, and our rights and obligations under them, without needing your consent.

23. Governing law

These terms are governed by the law of South Africa, and any dispute is subject to the jurisdiction of the courts of Gauteng.

24. Changes to these terms

We may update these terms from time to time; the version in effect is the one posted on the Site when you place your order. Continuing to use the Services after a change is posted means you accept it.
